These Terms of Service ("Terms") govern your use of the DEEP - Sleep. Train. Eat. mobile application (the "App") operated by DEEP ("we," "our," or "us"). By downloading, installing, or using the App, you agree to these Terms.

1. Use of the App

DEEP provides health tracking, fitness planning, nutrition logging, and AI-powered coaching tools. You must be at least 13 years old to use the App. You are responsible for maintaining the confidentiality of your account credentials.

2. Health Disclaimer

DEEP is not a medical device and does not provide medical advice. The App provides general health and fitness information, AI-generated insights, and tracking tools for informational purposes only. Content in the App is not intended to diagnose, treat, cure, or prevent any disease or health condition.

Always consult a qualified healthcare professional before starting any exercise program, diet plan, or making changes based on information in the App. If you experience any health issues, seek medical attention immediately.

Sleep analysis, readiness scores, and AI coaching are based on algorithms and general health guidelines — they are not medical diagnoses.

3. Subscriptions & Payments

DEEP offers free and premium (Pro) tiers. Premium features require a paid subscription:

Subscriptions are billed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase. Monthly and annual subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

You can manage or cancel subscriptions in your Apple ID account settings. No refunds are provided for partial billing periods. Free trial periods, if offered, convert to paid subscriptions unless canceled before the trial ends.

4. User Content & Data

You retain ownership of all data you enter into the App (meals, workouts, profile information). By using the App, you grant us a limited license to process this data solely to provide and improve the App's features.

You agree not to use the App to store or transmit unlawful, harmful, or objectionable content.

5. Apple Health Integration

The App integrates with Apple Health to read and write health data with your explicit permission. Health data is governed by Apple's terms and our Privacy Policy. You can revoke access at any time through iOS Settings.

6. AI Features

DEEP uses artificial intelligence to provide health coaching, workout suggestions, and nutritional insights. AI-generated content is provided "as is" and may not always be accurate or appropriate for your individual circumstances. AI features are not a substitute for professional medical, nutritional, or fitness advice.

7. Intellectual Property

The App, including its design, code, content, and branding, is owned by DEEP and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

8. Account Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that is harmful to other users or the App. You may delete your account at any time from within the App, which will remove your personal data from our servers.

9. Limitation of Liability

To the maximum extent permitted by law, DEEP and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

We do not guarantee uninterrupted or error-free operation of the App.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will notify you of material changes through the App or this page.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in accordance with applicable law.
