2. Use of the App

    •    Eligibility: You must be at least 16 years old to use DEEP. If you are under the age of majority in your jurisdiction, you must have your parent or guardian’s consent.

    •    Personal Use Only: The app is for personal, non-commercial use. You agree not to reproduce, distribute, or sell any part of the app or its features without our written consent.

    •    Health Disclaimer: DEEP provides insights and recommendations based on your sleep data. It is not a medical device and should not be used to diagnose, treat, or cure any medical condition. Always consult a healthcare professional for medical advice.

3. User Responsibilities

By using DEEP, you agree to:

    •    Provide accurate information when creating an account or interacting with the app.

    •    Keep your account credentials confidential.

    •    Use the app in compliance with all applicable laws and regulations.

    •    Refrain from using the app in any manner that could harm, disrupt, or interfere with its functionality or other users’ experiences.

4. Subscriptions and Payments

Certain features of DEEP may require a subscription or one-time payment.

    •    Free Trial: If a free trial is offered, it is limited to one per user. You must cancel before the trial ends to avoid charges.

    •    Billing: Subscription fees will be charged to your Apple account at the time of purchase and automatically renewed unless canceled at least 24 hours before the renewal date.

    •    Refund Policy: All payments are final and non-refundable, except as required by law or explicitly stated otherwise.

5. Intellectual Property

All content within DEEP, including but not limited to text, graphics, logos, and software, is the property of Sparrow Enterprises, Inc. or its licensors. You agree not to copy, modify, distribute, or reverse-engineer any part of the app without prior written consent.

6. Third-Party Services

The app may include integrations or links to third-party services, such as Apple HealthKit. We are not responsible for the content, policies, or practices of any third-party services. You use these services at your own risk.

7. Data Collection and Privacy

Your use of DEEP is subject to our Privacy Policy. By using the app, you consent to the collection, use, and sharing of your data as described in the policy.

8. Limitation of Liability

To the fullest extent permitted by law:

    •    DEEP is provided “as-is” and “as available,” without any warranties or guarantees, express or implied.

    •    Sparrow Enterprises, Inc. is not responsible for any indirect, incidental, or consequential damages resulting from your use of the app.

9. Termination

We reserve the right to suspend or terminate your access to DEEP at any time, for any reason, without notice. Upon termination, you must stop using the app and delete all copies from your devices.

10. Updates to Terms

We may update these Terms periodically. If changes are significant, we will notify you through the app or email. Continued use of the app after updates constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state of South Carolina, without regard to conflict of law principles.
